If you are an existing borrower or Guarantor you do not need to "opt in" for us to communicate with you, nor can you "opt out". You have agreed that we can contact you by email, SMS, telephone or surface mail or any combination of these or any other methods of communication in terms of our mutual business. You must still opt in to receive marketing and promotional material, but you can opt out at any time. We don’t share your data for marketing purposes with any third parties so there is no opt in.
If you are using the website, making enquiry or responding to general marketing activity, and are not an existing or past borrower or guarantor, then you must give us permission to contact you, "opt in", and this will be specific to the communication method offered/chosen, normally at least email and telephone. If you opt in you can "opt out" at any time by updating your details through My Account or by clicking unsubscribe from any marketing communication you have received from us.
Simply Put;Keep in touch by whatever means you prefer, but for existing customers we will use any method that works. For those who are not customers and wish to communicate you MUST opt in.
We acknowledge our responsibility to protect and manage the information you share with us. We use computer safeguards such as firewalls and data encryption as well as physical controls to our buildings , computers and files. Your data can only be accessed by those employees who require it to fulfil their job.. We may also record and/or monitor telephone calls and Instant Messaging to ensure consistency, quality and for staff training. Such recordings may also be used to resolve disputes and combat fraud.

INFORMATION WE HOLD ABOUT YOU
We will hold and use the following details about you:
- Your name, address, phone numbers, email address, date of birth, employment and banking and financial details and National Insurance (NI) Number.
- Demographic and lifestyle information.
- Information we receive when making a decision about you, your loan or application (including information collected from CRAs and similar information providers) your Guarantee & Indemnity or application.
- Details of the loans you or the person you have Guaranteed have and have had with us and all related transactions.
- Details of when you contact us and when we contact you.
together with any other information which we reasonably obtain to operate your account, make decisions about you or fulfil our regulatory obligations.
We may keep details of any phone number(s) that you call us from and use them to contact you.
If you provide us with any debit card details, either during the loan application or subsequently, we (or compliant provider) will keep those details and may use the details to take further payments both on your current loan and on any subsequent loans, unless you advise us otherwise. If a card is identified as having been used fraudulently then we will maintain a record of its use for reporting and preventing fraud; the card details will be deactivated to ensure that they can no longer be used to take payment.
When we are managing your account, we may be given sensitive information such as medical information. We will hold and process this information to allow us to make decisions about you and your account(s) with us.
References to personal information include all of the information above whether obtained from you, from a Credit Reference Agency or Fraud Prevention Agency, from the internet or from any other source.
We will hold your data on our systems as follows:
- If you have taken out a loan - 7 Years from the end of the loan.
- If you have had a loan declined - 3 Years from the date of decline.
- All other scenarios - 28 days.
- If you have opted into marketing then we will hold your contact details (email address, telephone number, name and address) for up to 36 months from the time you last interacted with us. You may opt out of this at any time by updating your details through My Account or by clicking unsubscribe from any marketing communication you have receive from us.

SHARING YOUR INFORMATION
NB: This section applies to any Applicant, Borrower or Guarantor as noted.
The information which you provide will be used by us and other members of our group or selected third parties to consider and administer any application and loan. You agree that we may hold and process, by computer or otherwise, any information we gain about you as a result of this agreement and any other agreements or applications you have made with or to us.
Where necessary, for any of the above purposes, as well as the prevention of fraud and money laundering, we may disclose your personal data to our regulators, to other members of our group and to fraud prevention and law enforcement agencies, credit reference agencies or to anyone to whom we transfer or assign (in whole or part) our rights and duties under this agreement.
We may also disclose your personal data to third parties (such as mailing agencies) to fulfil this agreement. We may also disclose information regarding payments made under the account to the third party that introduced you or the Borrower to us (eg credit broker, web comparison sites).
We do not share your information with third parties, may use your information to inform you, by post, fax, telephone or other electronic means, about other products and services (including those of others) which we believe may be of interest to you. If you are not eligible for the LendFair loan applied for at this time then we may offer you an alternative product (including those of others) in the future.You may opt-out of receiving marketing communications from us,where you have previously opted in, by responding to any of our email communications with "remove" in the subject line, by sending us an email to email@example.com or by writing to us at the address provided above. If you opt-out of our use of your data for marketing purposes, we will honour such choice once we have had a reasonable opportunity to process your request. We reserve the right to take reasonable steps to authenticate your identity with respect to any such request or other enquiry.
Your data may also be used for other purposes for which you give your permission or where we are permitted to do so by law or it is in the public interest to disclose the information or is otherwise permitted under the terms of the Data Protection Act 1998.
Simply Put; We will share information about you as the law allows, or that you have agreed to.We will not share your information with other loan companies or organisations marketing products and services.
We use Google Analytics’ 3rd-party audience data such as age, gender, and interests to better understanding the behavior of our customers and work with companies that collect information about your online activities to provide advertising targeted to suit your interests and preferences. For example, you may see certain ads on this website or other websites because we contract with Google and other similar companies to target our ads based on information we or they have collected, including information that was collected through automated means (such as cookies and web beacons). These companies also use automated technologies to collect information when you click on our ads, which helps track and manage the effectiveness of our marketing efforts. CREDIT REFERENCE AGENCIES
NB: This section applies to any Applicant, Borrower or Guarantor as noted
When you apply for a LendFair Loan, or where you offer to be a Guarantor we may perform a credit check on you and look at your credit file at credit reference agencies such as Credit Safe, Call Credit or Experian. This will include information from your credit application and about your financial situation and financial history, CRAs will supply to us both public (including the electoral register) and shared credit, financial situation and financial history information and fraud prevention information.
We will use this information to:
- Assess your creditworthiness and whether you can afford to take the product;
- Verify the accuracy of the data you have provided to us;
- Prevent Criminal activity, fraud and money laundering;
- Manage your account
- Trace and recover debts; and
- Ensure any offers provided to you are appropriate to your circumstances
We will continue to supply information about you to the credit reference agencies while you have a relationship with us, we will also inform the CRAs about your settled accounts. If you borrow and do not repay in full and on time, CRAs will record the outstanding debt. This information may be supplied to other organisations by CRAs.
When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders.
If you are making a joint application or tell us that you have a spouse or financial associate we may link your records together, so you should make sure you discuss this and share with them this information before making your application. CRAs may also link your records together and these links will remain on your and their files until such time as you or your partner/associate successfully files for a disassociation with the CRAs to break that link.
To prevent fraud, we will check your details with fraud prevention agencies. If you provide false or inaccurate information and we or the agencies suspect fraud, we or the agencies will record this.
We and other organisations may use and search these records to help make decisions about credit and credit related services for you and members of your household, prevent fraud, recover debt, trace debtors and generally manage your account(s) as well as to check your identity to prevent money laundering.
These credit reference agencies and fraud prevention agencies will also use their records for the statistical analysis of credit and fraud.
The identities of the CRAs, their role also as fraud prevention agencies, the data they hold, the ways in which they use and share personal information, data retention periods and your data protection rights with CRAs are explained in more detail at https://www.callcredit.co.uk/crain

Simply Put; To protect our business and comply with our Consumer Credit Authorisation, we share information with credit reference and fraud prevention agencies.

English law governs these conditions and you agree that the English Courts shall have exclusive jurisdiction to determine any matter or dispute arising out of this site policies and conditions.
LendFair only offer loans to UK resident individuals with a UK bank account.
If any single clause contained in these terms and conditions is found to be legally invalid (unfair), it will be deleted and any contract shall continue to bind the parties if it is capable of continuing in existence without the unfair term.
